The implementation deadline for Europe’s RoHS Directive has passed. As industry reflects on “lessons learned” in the run-up to RoHS and faces the question of how to cost-effectively integrate compliance management into long-term business processes, the next wave of product-related environmental regulations are emerging. “RoHS”-like regulations are coming into effect around Asia-Pacfic and Europe’s REACH Regulation is due to be implemented in early-2007. These two key new developments further impact the use and management of hazardous or potentially-hazardous substances in products.

Dr. Ted RichardsDr Ted Richards, Principal Toxicologist, WSP Environmental, one of the UK's leading experts on REACH, having tracked and advised on the development of the Directive for the past six years. He has over 22 years industrial experience, over 16 of which have been spent working in the fields of environmental and regulatory affairs. Experience in Product Stewardship led to Ted been invited to join the Supply Chain Leadership Group, which was set up by the Chemicals Industry Association and the British Retailers Consortium to address information flow up and down the supply chain. Ted has drawn up a Best Practice Guidance document for the textile and clothing sector that has been used as a template for other supply chains. Ted is also currently Chairman of the Global Acetate Manufacturers Association (GAMA) Regulatory Affairs Committee. He also sits on various committees in other trade associations including the UK Chemical Industry Association (CIA). Acting in the role of a consultant within industry Ted has provided businesses with expertise in toxicology, environmental risk assessments, emerging legislation and Product Stewardship issues, assisting businesses to gain a competitive advantage thru proper product risk management. Ted has both a BSc and PhD in Chemistry from the UK as well as post-doctoral experience in Organic Chemistry at the University of Minnesota, USA, and an MSc in Toxicology.

 

 

 

 

Andrew SweatmanAndrew Sweatman, Senior Manager, WSP Environmental, founded a global product regulatory tracking company in the 1990s in Melbourne, Australia, which was acquired by WSP Environmental earlier this year. Andrew’s work includes delivery of EIA Track to members of the Electronics Industry Alliance. Andrew is a recognized world- leading expert on product stewardship issues for the electronics and clothing sectors with 15 years experience in this field. Andrew is a co-author of a key text on this subject called “Design + Environment” published in the UK and distributed globally including translations into Chinese.
This unique area of expertise is complemented with his information technology skills which allow such consulting services to be delivered to global clients via the internet in the form of web-based regulatory tracking and e-learning solutions.

 

 

 

 

 

 

Maureen BennettMaureen Bennett, Squire Sanders, a partner in the corporate and environmental practice groups. She assists lenders, developers, buyers and investors in assessing and quantifying environmental risks, structuring appropriate risk allocation arrangements and determining permit requirements involving commercial properties, including manufacturing and power generation facilities. She also is an active member of the firm's international environmental practice group, with a focus on Asia. She monitors emerging environmental legal issues in Japan and China, including Japan's "superfund" law and China's regulation of hazardous materials. She assists clients with the negotiation of product content requirements in supply-chain agreements.
Ms. Bennett also assists pharmaceutical and agricultural chemical companies in connection with cross-boundary acquisition and investment transactions, as well as product supply, manufacturing, development and clinical trial agreements.


 

 

 

Background:

 

EU REACH

 

The new Registration, Evaluation, and Authorisation of Chemicals Regulation (REACH) is due to come into force in the first half of 2007. REACH has been hailed as the largest and most complex piece of legislation to be introduced in Europe.

 

REACH will drive major changes through the worldwide chemicals industry, and also require significant action by users of chemicals. Many chemicals are likely to disappear from the market.

 

US manufacturers need to address REACH if they export to the EU. Chemicals in “articles” that are designed to be emitted during use will need to be registered. Manufactures will need to demonstrate the chemical is registered for that use, or possibly take the chemical though the REACH process themselves. Even products not designed to emit chemicals are likely to be captured by a 'notification' procedure.

 

Asia-Pacific "RoHS"

 

The Asia-Pacific region is a fast growing market for product sales. Many of the countries in this region are considering RoHS type regulations. These include China, Japan, Korea, Taiwan, Australia and New Zealand.

 

It is critical for companies to understand the key deadlines and requirements for each of these markets to ensure free market access.

 

Some the key issues are of concern are:

 

  • China deadline of March 1, 2007 for RoHS marking of almost all products

  • Japanese label requirements which started in July 2006

  • Korean requirements that simultaneously cover WEEE, RoHS and EUP.

  • Australia and New Zealand taking measures to prevent non-RoHS compliant product dumping
